In this Pay Now Authorization and Agreement ("the Agreement"), the words "we", "us", and "our" mean Affirm Payments, LLC including its successors, assigns, agents, affiliates, and service providers and "Merchant" means the third-party person or company who will be providing and/or delivering merchandise or goods/services to you. The words "you" and "your" mean the customer signing below.
The following terms and conditions apply to your use of Affirm Pay Now ("Pay Now"). These terms, combined with the Affirm Terms of Service (https://www.affirm.com/terms), form the Agreement. Affirm is located at Affirm, Inc., 30 Isabella Street, Floor 4, Pittsburgh, PA 15212.
This Agreement is provided to you in electronic format pursuant to the E-Sign Consent Agreement that you accepted and agreed to when you opened your Affirm account. By clicking the button below this hyperlinked Agreement, you are electronically signing and agreeing to this Agreement.
Pay Now allows you to pay in full for a purchase made using Affirm with a separate debit card or, at a select number of merchants, a credit card ("Payment Card").
Today's transaction. Except as set forth below, Affirm will charge your Payment Card today for the amount disclosed to you during the checkout process ("Purchase Amount") with an Affirm merchant ("Merchant"). If the Merchant confirms your order on a later date, such as if there is a delay before it is shipped, your Payment Card may not be charged until that time.
Refunds. Returns and cancellations are governed by the Merchant's terms and return policy. For questions on whether a purchase can be canceled or returned, please ask the Merchant. We will provide you with a refund if funds are returned to Affirm by the Merchant. When Affirm processes refunds, it will be to your original payment method.
Fees. There are no fees for use of Pay Now. Pay Now is not a loan and there are no interest or finance charges. Affirm is not responsible for any fees, interest, or other charges imposed by the financial institution that issued your Payment Card to you (including finance charges, overdraft, and NSF fees). For questions about those fees, please contact your financial institution.
Additional Terms and Conditions:
Purchase Amount. This is the amount displayed on the checkout screen. It equals the total amount of the cost of any goods or services in your cart, which may be adjusted to include (i) any applicable taxes, shipping costs, or other fees that you have authorized and that are charged by a Merchant, (ii) any goods or services added to your order after you agree to this Agreement but before checking out with the Merchant, or (iii) any reductions or increases due to exchanges or returns applied to your current cart. If you have questions about the Purchase Amount, ask the Merchant. Each purchase will be processed in U.S. dollars.
Authorization and Promise to Pay. By using Affirm Pay Now to pay for this purchase, you are authorizing and instructing us to send the Purchase Amount to the Merchant as payment for the purchase and to limit the Merchant's ability to receive the Purchase Amount for a period of time we have agreed with the Merchant. You promise to pay Affirm the Purchase Amount in accordance with this Agreement, and authorize us to charge the Purchase Amount to the Payment Card that you specify at the time of your purchase. You promise that your Payment Card is open, in good standing and active, and that you are either the primary cardholder or an authorized user of the Payment Card. This authorization remains valid until the Merchant informs us it has processed your order, which may not be today.
Acceptance. We reserve the right to not accept specific Payment Cards for use with Pay Now. We do not currently permit payments from prepaid cards or gift cards. You understand that this Agreement is subject to applicable law and network rules governing your Payment Card.
Correction of Errors. You authorize us to charge your Payment Card as necessary to correct any error we may make in processing a payment on or after the date such error occurs.
Rejected and Reinitiated Payments. Unless otherwise limited by law, if any payment under this Agreement is rejected or otherwise returned unpaid or partially unpaid, you authorize us to reinitiate it up to two additional times. However, you agree that we are under no obligation to reinitiate any rejected charges. You understand that your financial institution or card issuer may impose fees in connection with rejected charges, and you agree that we do not have any liability to you for such fees.
Storing Payment Method Details. Unless you opt out, we may store your Payment Card details in our systems and use this information to prefill your payment method details for future transactions with Affirm until you ask us to remove your Payment Card from our systems. You may manage your payment method details online or through the Affirm app. In the event Affirm obtains updated information related to your Payment Card, you agree that we may update and use this information in our system. Affirm is only storing payment credentials; we do not store funds on your behalf.
Default. Except where prohibited by law, you will be in default if we are unable to charge the Purchase Amount to your Payment Card ("Default"). If you are in Default, Affirm may: (i) employ a debt collection agency to collect payment; and (ii) report default information to credit bureaus. If you are in Default, Affirm may prevent you from future use of any Affirm service.
Governing Law and Dispute Resolution. Disputes under this Agreement are subject to the dispute resolution provisions of Affirm's Terms of Service, section 5, titled, "How Affirm Will Resolve Disputes." Please note that disputes are governed by the Arbitration Agreement and Class Action Waiver contained there.
